Based upon the info provided below, the new owner does not plan a new use at least according to the permit application filed.  Please contact me immediately if you see the property being used for something other than a grocery store and the CVCA Land Use Committee will consider filing a formal protest.  Until then, I have to proceed on the facts as Katie Rose has given them to me.

Sharon, Thanks for contacting me. 

I just pulled the permits, and it looks like the permit approving a “change of ownership” is currently under review. The new lessee is a “deli/grocery” though since it is just outside the Charles/25th URP, I will not get to review it (I typically only approve URP or PUD permits in my district). The permit has been approved by the zoning office, and is awaiting building, fire and health department inspections. 



A little bit more on why zoning would have approved this… the property is currently (and should be in the next code) zoned residential, R-6; however, the non-conforming use as a grocery store pre-dates the 1971 zoning code and is thus “grandfathered” in. As long as the non-conforming use is not expanded or terminated, the use is allowed to continue, even if ownership changes, and does not require BMZA or “Board” approval. So to answer your original question about ‘protesting a change in use,’ technically, there is no evidence of a change in use per se (it’s allegedly going from a grocery store to a grocery store), and I have no evidence at this time of a proposed fried chicken establishment. 



My recommendation if you have serious concerns about this property being used for a purpose other than that stated in the permit application would be to contact the zoning office (410-396-4126) regarding this matter, and I suggest using the property address of 219 E. 27th Street (physical address) or 2648 Guilford Avenue (mailing address). The permit number is USE2011-03311. Let’s be in touch, too, if there are any new developments in this case.
